Four Beaverton school bus drivers say a Concentra doctor touched them inappropriately during employee physicals.

Four plaintiffs, identified only by pseudonyms, filed suit against Concentra Health Inc., a Texas-based healthcare provider with offices in Portland and Washington County.

Concentra specializes in occupational healthcare services, providing physical exams, drug testing and care for workplace injuries, among other services.

According to the complaint filed Feb. 20 in Multnomah County Circuit Court, the drivers say Dr. Christopher Baldwin touched them inappropriately during routine physical exams and adjusted their clothing to peer at their chests.

During a physical exam of a female patient on Feb. 28, 2018, the complaint alleges, Baldwin "touched Plaintiff's leg, thigh, and pubic area, without Plaintiff's consent or medical justification."

The patient, identified in the lawsuit only as "A.A.," reported the behavior to her husband but took no further action for fear of not being believed, according to the suit.

During another exam in October 2019, the complaint describes Baldwin grabbing the shirt collar of a different patient, pulling it from her body and looking down at her breasts "without consent or medical justification."

According to Concentra's own website, exams may vary by profession, but a standard physical exam typically includes a check for vital signs; vision; inspection of the head, eyes, ears, nose, and throat; gastrointestinal function; cardiovascular and respiratory checks; musculoskeletal assessment; neuro exam; and skin and lymph node checks.

Barbara Long, the attorney representing the plaintiffs, said her clients notified their employer, law enforcement, and at least one of the women filed a complaint with the Oregon Medical Board.

Calls to the OMB confirm Baldwin is still licensed and practicing and has no reportable malpractice claims or complaints. However, complaints resulting in no board action are never disclosed to the public, OMB clerks said.

"At least one of them complained to the medical board," Long said Monday of the four plaintiffs. "At least two spoke to law enforcement. All of them spoke to their employer. They're completely unsatisfied with the response that they've been getting to their complaints. This civil lawsuit is a last resort for them."

Long noted that when one of the plaintiffs inquired about the results of her complaint to the state medical board and any ensuing investigation into Baldwin, she was told she'd never find out the outcome.

Concentra declined to comment on the lawsuit, saying in a prepared statement, "Out of respect for the process and parties involved, we don't comment on pending investigations."

Concentra named in previous Oregon lawsuit

This isn't the first time Concentra has been implicated in an Oregon lawsuit. In 2015, records show a former Concentra Health employee filed suit against Daimler Trucks and Concentra, alleging unlawful employment practices from Concentra. In that case, the Concentra employee was terminated days after reporting a member of Daimler's management team to an ethics hotline, as well as a federal civil rights agency for suspected HIPAA violations and other improper treatment practices and interference in Daimler employees' medical care.

That case was later moved to federal district court and settled out of court, records indicate.
