Proposed change would only allow one marijuana grow site or one premises licensed for marijuana production in three rural zoning districts

Clackamas County is proposing zoning changes to limit the number of marijuana production licenses permitted on a contiguous tract of land under the same ownership.

If approved, amendments to Clackamas County's Zoning and Development Ordinance would only allow one marijuana grow site or one premises licensed for marijuana production in three rural zoning districts. These areas include zoning designations for timber, agriculture/forest and exclusive farm use.

Other zones where local marijuana production is permitted already have significant limitations on building square footage for such production and a prohibition on outdoor production.

Medical marijuana grow sites are registered by the Oregon Health Authority, and the Oregon Liquor Control Commission issues licenses for marijuana production facilities.

County officials say that multiple OLCC-licensed production premises and/or OHA-registered grow sites already located on a single tract may be considered a "legal nonconforming" use (sometimes referred to as a "grandfathered right") if the proposed zoning changes are adopted.

Proposed changes would clarify — but not substantially change, county planners say — marijuana production and processing requirements related to the qualifications of an engineer conducting odor mitigation or acoustical studies; the equipment subject to noise standards; the use of shared access easements and private drives; and structural setbacks.

County officials will hold public hearings in November and January to consider the proposed amendments to zoning ordinances affecting marijuana production, processing and retailing. The Clackamas County Planning Commission will hold a 6:30 p.m. public hearing Monday, Nov. 26, in the Development Services Building Auditorium, 150 Beavercreek Road, Oregon City. The Board of County Commissioners will hear public testimony at a 9:30 a.m. meeting Wednesday, Jan. 16, on the fourth floor of the Public Services Building, 2051 Kaen Road, Oregon City

Draft amendments are available to review at or in person at the Planning & Zoning Division, located on the second floor of the Development Services Building, 150 Beavercreek Road, Oregon City.
