Michael Tulipat is a resident of Oregon City who is currently suspended with pay from his job at CCC

I was hired by Clackamas Community College on May 9, 2016, and performed the duties of my assigned job in a satisfactory manner.

I Michael Tulipatwas a whistleblower on CCC's pesticide-use violations, discrimination and workplace bullying. On April 5, they formally suspended me with pay and started to make email announcements about their pesticide use. I am not allowed on campus, I had to drop out of classes, and they hired a lawyer who is trying to find anything on me that I violated.

Throughout my employment as groundskeeper at CCC, beginning about March 2017, I began to be subjected to a pattern of harassment through unwelcome conduct and unequal terms and conditions of employment because of requesting reasonable accommodation for a disability, my race, my national origin/ethnicity and/or complaints about discrimination that remains ongoing.

More recently, on about Nov. 28, 2018, I was denied developmental opportunities that were extended to similarly situated employees outside of my protected group. In addition, Lloyd Helm, director of campus services, made a comment towards perceiving me as a foreigner within the lines of: "Are you sure you're a citizen?" I immediately objected to the conduct by reporting it to Chris Smith, HR compliance specialist at CCC, and Robert 'Bob' Cochran, the college's dean of campus services. Shortly afterwards, Mr. Helm scolded me for complaining to Mr. Cochran.

In January, I became aware that Oregon Backflow Training was available, and requested to Mr. Helm the developmental opportunity. In response, Mr. Helm disregarded my request, and instead offered it to a similarly situated white employee.

The harassment escalated through a joke, in my presence, to another Asian coworker who was made fun of for going on a cruise. Mr. Helm stated something to the effect of: "You can't take a cruise, because they don't cook rice on it."

A maintenance carpenter also joined in the harassment, and began drawing comparisons between me, foreigners and fraud. For instance, on one occasion CCC Maintenance Specialist Delbert Dulley began stating that Mexicans are taking advantage of our government while at the same time implying that he was surprised that I had a second job when my people take advantage of the government. On another occasion he suggested that my white coworker could do things right, but I couldn't.

Despite consistently reporting the hostile work environment, CCC took no corrective action. About the end of March of 2019, the maintenance carpenter began interrogating me about leaving work. I confronted him letting him know that it wasn't any of his business and telling him that his bullying needed to stop. I reported the conduct to Chris Smith, but, on March 21, instead of addressing the harassment the maintenance carpenter continued to engage in, I was suspended and denied access to CCC's facility. The reason stated was that Mr. Dulley had filed a complaint against me. To my knowledge, the college has never suspended similarly situated employees after complaints have been lodged against them, nor did it suspend the maintenance carpenter because of my complaint. I believe that under similar circumstances, CCC treated white and/or American employees preferentially.

I believe that I have been subjected to unequal terms and conditions of employment, suspension and harassment because of my race, Asian; my national origin and/or ethnicity, Filipino; and/or in retaliation for having engaged in protected activity, in violation of Title VII of the Civil Rights Act of 1964, as amended. I believe I have been subjected to unequal terms and conditions of employment, suspension, and harassment because of a disability, and/or in retaliation for having requested FMLA as reasonable accommodation, in violation of the Americans with Disabilities Act of 1990, as amended.

I have submitted a former charge of discrimination against CCC to the Oregon Bureau of Labor & Industries Civil Rights Division. I feel like this is unfair and people should know.

Michael Tulipat is a resident of Oregon City. Lori Hall, college spokesperson, said last week that CCC has not received a tort-claim letter from Tulipat, and beyond that, Hall said that college officials cannot comment on the ongoing investigation.
