Five day civil trial finds defendants not guilty of negligence, plaintiff at fault for injuries

Recently, Molalla City Manager Dan Huff found himself sitting at a five-day civil trial brought by Karol Parham for negligence by the city and contractor Eagle Elsner Inc.

Huff noted that Parham issued the civil lawsuit against the city and contractor due to a slip and fall from a water line replacement project from 2015. After five days of testimony, on Sept. 26, the12-person jury found the city and the contractor weren't negligent and that the plaintiff was at fault for her injuries.

The city manager was obviously pleased to find the city off the hook, "We were accused of being negligent and we defended ourselves in front of a jury," Huff told the Pioneer. It's not known, but likely the plaintiff had to pay court costs.
