COURTESY PHOTO: MULTNOMAH COUNTY SHERIFFS OFFICE - Brian Christopher MillerThe Multnomah County District Attorney's Office is investigating possible bias crime charges after a violent attack was caught on camera at a Southeast Portland gas station.

A video taken during the confrontation shows 43-year-old Brian Christopher Miller yelling slurs and throwing items at the 68-year-old man working behind the counter, who filmed the attack. Miller allegedly went in to buy cigarettes Friday night, Jan. 22, at the convenience store near Southeast Division and 145th Avenue.

In the video Miller can be heard shouting, "Is that how we do things in America — Afghan, Al-Qaeda, Osama, huh, is it?" Miller continued to swear and said he would "shoot you in the back" while the employee called 911 for help and fled the store out the backdoor. In the video Miller toppled over display cases and threw things at the victim.

Miller was arrested the following day on criminal mischief and robbery charges and was released.

The District Attorney's Office sent a statement Sunday evening, Jan. 24, saying, "All potential bias crimes cases, whether they are a felony or misdemeanor, are reviewed by the Violent Crimes Unit within the Multnomah County District Attorney's Office. We have been working with the Portland Police Bureau's Bias Crime detective to gather all available police reports and evidence associated with this incident."
